HOW IT WORKS...

  • Read the Terms and Conditions FIRST.

  • Fill out the commission form linked down below. There you can select the type of commission you want and leave a brief description of it (you can also attach images, photos and other visual references to help me understand what you want for your character there).

  • After I approve your commission request, I will contact you to review the details, pricing and delivery dates.

  • I will then create an illustration for you in my art style. You will receive the finished, high resolution piece via WeTransfer email download approximately 2-3 weeks after full payment has been received.

Clients must read and confirm they agree with the following terms and conditions in order to place commission order.

TERMS & CONDITIONS

1. GENERAL TERMS

  • All illustrations come with a watermark/signature. This signature must not be removed (see point 5 on copyright & Usage policy)

  • I, Gary Lister (the artist) have the right to reject any commission request that I do not feel comfortable doing.

2. PAYMENT

  • Payment is in USD currency via PayPal. Other payment methods can be discussed.

  • Commission payment can be done either 100% upfront or in two installments of 50% each (first payment before I start working and the second after the sketch has been approved).

  • Do not send any payment before we discuss all the details of your commission and I accept your request.

3. PROCESS AND DELIVERY

  • After payment, I will provide you with a rough sketch to review the main details of your piece.

  • You will be able to review the sketching process and request modifications to the pose/composition before I move on to adding color.

  • Once you approve the sketch, you will get updates throughout the process if you chose to pay 100% upfront, although only minor changes are allowed after this point. (See point 4 on revisions and changes).

  • The finished commissioned artwork will be delivered digitally via WeTransfer within 2-3 weeks after payment has been received. You will be notified if this changes due to external factors such as artist’s health, availability, increase in complexity due to additional changes (see section below), or delays in response from the client when revisions are needed.

4. REVISIONS & CHANGES

  • Client will have an opportunity to make any major changes (as long as these stay within the agreed upon budget) during the sketch/rough draft phase of the process. After I send the sketch and it has been reviewed and approved by the client, only small details/adjustments can be made. Major composition / structural changes are no longer allowed.

  • Clients who choose to pay 100% upfront will receive updates throughout the entire process. However, once I start coloring, they can only request small changes/adjustments.

  • Clients who choose to pay 50/50 will not get to see the rest of the process after the sketch until the payment has been completely fulfilled.

  • If the client insists on making major changes later in the process, those changes will be charged separately accordingly. I reserve the right to decline the requested major changes if I choose so.

5. COPYRIGHT / USAGE POLICY

  • I, Gary Lister (the artist), will own the rights to any produced drawing unless specified otherwise under a contract. As the copyright holder, I hold the rights to:

  • Post the piece on any of my social media, portfolio or websites at any time.

  • Reproduction rights.

  • Make any changes/modifications to the piece after it is delivered for personal use or commercial use. This includes re-using the pose, composition and/or color palette. This does not include the character/ character design itself that belongs to the client (unless the client commissioned the artist to design the character as well, which is discussed individually per commission).

  • Use it for self promotion.

  • The client is allowed to use the piece for personal use only. This includes printing the artwork for themselves, claiming the character included as their own if they are not copyrighted by another entity/individual, and post/use the artwork on their social media as long as credit is given and no monetary profit is gained from the image.

  • The client is NOT allowed to sell, modify, reproduce, or make money/profits from the artwork in question in any way or form. This includes selling it as merchandise, prints, stickers, used on editorial products, NFTs or digital assets, etc. Doing any of the latter is copyright infringement and will be pursued accordingly.

  • As the artist, I reserve the full rights to the image and it's use/distribution unless otherwise agreed upon under a specific contract previously negotiated.

  • If the client later decides to use the piece for non-personal purposes, they can request to buy the rights for commercial use under contract and will be charged separately according to the price difference that may vary depending on what the client requests. As the artist, I have the right to refuse to provide non personal / commercial rights to an image that was originally commissioned for personal use.

6. CANCELATION POLICY / REFUNDS

  • Client can not request a refund after I have started working on their commission.

  • If for any reason I, the artist, see myself not able to start / finish the commission due to unexpected circumstances, I will refund 100% of your payment and the commission will be cancelled.

  • If you are getting a refund, please do not request a PayPal chargeback, I will transfer the money back to you myself.

  • If you request a chargeback, even when you were not allowed a refund, your commission will be immediately cancelled. Chargeback will be declined and I will send Paypal our conversations as proof that work has been completed and terms and conditions were broken by you, the client. You will then be blacklisted from any future commissions.

  • If client breaks any of the terms and conditions, they will lose all the aforementioned rights to the artwork they commissioned and I, will retain full right to profit from the artwork created as I see fit.

7. CUSTOMER SATISFACTION

  • Making you, the client, happy with your commission is my top priority, so please, if you have a problem regarding the artwork you've commissioned, please notify me so we can find a solution together *(As long as the solution doesn’t break any of the Terms and Condition points aforementioned here).

  • As much as I would love for my customers to be 100% happy with the commissioned result, there’s always a possibility that such thing might not be the case. However, claiming dissatisfaction does not warrant a refund (point 6), as the client has several instances throughout the process to voice any issues they may have with the piece to prevent this (read point 4 on revisions).
